Oral arguments to be delayed in former Southaven Mayor’s trial so attorneys can go on vacation.

Oral arguments in former Southaven Mayor Greg Davis’s appeal of a state order that he repay more than $73,000 have been delayed until Aug. 5, the Mississippi Court of Appeals announced Friday.

The case was postponed because of vacation plans by Davis’s attorney, Michael A. Heilman, according to the request for delay filed with the court. In its response, the state agreed to the delay but noted that its counsel in the case, Melissa C. Patterson, also has vacation plans Aug. 8-12 and asked the court to therefore stay clear of those dates as well.

Davis had been scheduled to make his case before the appeals court next Tuesday.

Davis, according to briefs filed by Heilman, is arguing that credit card charges reimbursed by Southaven aldermen were legal and that none of the claims were ever rescinded by the board.
